California Law: SB 442 — Pool Safety at Point of Sale

California Senate Bill 442, signed into law in October 2017 and effective January 1, 2018, directly affects how homes with a pool or spa are sold. Under SB 442 (codified as Business & Professions Code §7195), when a home with a swimming pool or spa is transferred — including any home sale — the home inspection report must identify which of the seven drowning-prevention safety features are present, and must specifically state if the pool or spa has fewer than two. California requires at least two of the following seven features:

  1. Isolation fencing with a self-closing, self-latching gate that separates the pool from the home
  2. Removable mesh pool fencing with a self-closing, self-latching gate
  3. An approved safety pool cover
  4. Exit alarms on all doors providing direct access to the pool
  5. A self-closing, self-latching device on all doors providing direct access to the pool
  6. A pool alarm that sounds upon detection of accidental or unauthorized entry
  7. Other means of protection approved by the local building official

A standard home inspection includes a basic visual check of pool components, but a dedicated pool & spa inspection goes much deeper — testing equipment, evaluating safety features, and checking electrical bonding and grounding. The mechanical systems in a pool can cost thousands to repair or replace, so a specialized inspection is a smart investment.

California law also makes it mandatory. Under SB 442 (effective January 1, 2018), any home inspection performed in connection with the sale of a property that has a pool or spa must identify which of the seven drowning-prevention safety features are present and must specifically note if fewer than two are in place. A dedicated pool inspection ensures this legal requirement is properly satisfied and documented in your report.

Yes. The pool should be full of water with equipment operating for a complete inspection. If the pool is empty or equipment is not running, certain components cannot be evaluated and we will note those limitations in the report.

Yes. Dave has experience with in-ground concrete, fiberglass, and vinyl-liner pools of all ages, as well as integrated spas and hot tubs. Older pools may have more deferred maintenance, which will be documented thoroughly in the report.

Common safety findings include missing or damaged barrier fencing and gates, outdated or missing anti-entrapment drain covers, lack of GFCI protection near the pool, improper electrical bonding, and missing or non-functional pool alarms. These are serious concerns and the inspection report prioritizes them clearly.

This is a visual, non-invasive inspection — underground pipes, buried plumbing lines, and areas concealed beneath the pool shell or deck cannot be inspected for leaks. We evaluate all visible plumbing, equipment connections, and accessible fittings, and will note any signs that suggest a possible subsurface issue. If a leak is suspected, a dedicated leak detection specialist should be consulted.
